General sales conditions
As requested and agreed by the Purchaser hereafter called
the CLIENT, all services to be provided by DUBROVNIK TRAVEL are limited
by the terms and conditions of our General Sales Condition . Only the
services confirmed by DUBROVNIK TRAVEL in writing or by fax will be
provided and constitute part of a binding agreement. This agreement
is governed by the following terms and conditions with which the CLIENT
is in full agreement at the time of placing an order to DUBROVNIK TRAVEL.
Rates
Rates are calculated in good faith and quotations are valid for the
services requested. Rates are based on the requested number of participants
and given dates. Rates are based on current exchange rate and local
taxes effective on the date of executing the original price quotation.
The quoted prices are subject to alteration due to governmental legislation
such as increase of VAT or other relative taxes.
Payment Conditions
The payment schedule and deposits are according to the DUBROVNIK TRAVEL
itemized quotation offer. No booking is considered definite until the
receipt of written confirmation from the CLIENT. DUBROVNIK TRAVEL. reserves
the right to cancel or not provide any service for which deposits were
not receive on the due dates, or have not been fully prepaid in accordance
with the payment schedule. All invoices are only due and payable in
Euro by Certified check or Bank transfer, inclusive of Bank charges.
The final programme invoice is payable within stipulated payments schedule.
All unpaid amounts will automatically bear 15% interest per annum, effective
from the date of invoicing. Acceptance of a DUBROVNIK TRAVEL offer shall
imply acceptance by the CLIENT of all payment conditions.
Cancelation Terms
All cancellations must be notified to DUBROVNIK TRAVEL in writing. Unless
otherwise agreed in case of a total cancellation of the program all
deposits paid or due to DUBROVNIK TRAVEL up to the moment the cancellation
is received, will be forfeited for covering cancellation charges as
required by the local suppliers. Deposits not paid at the agreed date
are not excluded and remain due to DUBROVNIK TRAVEL. Partial cancellation
and reduction of participant numbers will be accepted provided they
that the number reduction does not increase the cost rates or does not
create cancellation penalties imposed by local suppliers. Final numbers
for all transportation must be advised 15 days from the start of the
program. Final Banqueting numbers must be advised 48 working hours before
delivery and will form the basis for the invoice calculation.
Refunds
During the operation of the programme, the value of wholly or partially
unused services for rooms or meals, transportation or any other service,
will not be refundable unless DUBROVNIK TRAVEL, themselves recover the
costs involved. Prorated cost refunds cannot be made in connection with
motor coaches, guides, couriers, portage, admission fees or similar
minor items, nor in connection with performing arts, venues, or other
special-event tickets.
Inspection Trips
DUBROVNIK TRAVEL, will provide (for a maximum of 3 persons) complimentary
management-level assistance for site inspections (maximum 2 days) including
complimentary transfers and program-related transportation within CROATIA,
by company car, and one lunch or dinner during the visit. If the programme
accommodation has been requested to DUBROVNIK TRAVEL we will also negotiate
free or reduced rates with hotels and other suppliers to keep inspection
costs as low as possible. CLIENTS are invoiced for, out-of-pocket expenses
for items of a personal nature or as invoiced to DUBROVNIK TRAVEL, by
its suppliers. Inspection expenses are payable even if the programme
is cancelled.
Liability
In making any arrangements under this Agreement, DUBROVNIK TRAVEL shall
act as agent only for on behalf of the CLIENT: Therefore, DUBROVNIK
TRAVEL, its employees, representatives or all other parties, agents
or organizations collaborating with DUBROVNIK TRAVEL shall in no way
be liable for any delay, accident, personal injury, illness, strike-action,
deviation, curtailment, loss of/or damage to baggage or other personal
property, unless such event is caused by intent or gross negligence
of DUBROVNIK TRAVEL, or one of its employees or representatives.
In the event of the occurrence of any major political
event and of Force Majeure (such as e.g. Flood, Fire, War, Civil Commotion
or Disturbance, Riots, Acts or Threats of Terrorism, Break-down of public
services or Amenities) at the place of destination of the Program, which
may affect the safety of travelers or prevent the trip from taking place,
DUBROVNIK TRAVEL reserves the right to cancel any or all services under
this Agreement. In that DUBROVNIK TRAVEL will endeavor to offer alternative
arrangements or will refund to CLIENT all recoverable amounts after
deducting costs, disbursements, payments or charges.
The CLIENT will ensure that any special decorations or
technical materials and equipment not supplied by DUBROVNIK TRAVEL,
or its nominated supplier, will meet all local and national safety requirements
and are properly and fully insured by the CLIENT. Full details of the
aforementioned to be submitted to DUBROVNIK TRAVEL for approval. DUBROVNIK
TRAVEL will accept no responsibility for any consequences arising out
of none compliance with these conditions, and in such case the responsibility
remains fully with the CLIENT.
Travelers and program participants shall inform themselves
with the competent authorities as to the documents required for their
voyage (passports, visas, etc...) and will insure themselves with all
or any necessary travel, accident, or lost baggage insurance. DUBROVNIK
TRAVEL cannot be held liable for the traveler's failure to comply with
these formalities or insure themselves.
Complaints
In case of any complaints the CLIENT must notify immediately and while
still in Croatia, DUBROVNIK TRAVEL who will try to rectify the matter
as soon as possible and in the best of its abilities. If the matter
cannot be rectified the CLIENT must notify the complaints to DUBROVNIK
TRAVEL in writing within 7 days.
Disputes
In the event of any dispute or disagreement resulting out of or in connection
with the services provided by DUBROVNIK TRAVEL, all claims are governed
by the Croatian Law. The Court in Dubrovnik will have sole jurisdiction.
